Terms of Service

By creating an account, subscribing, or using precheckpros.com (the “Service”), you (“you,” “Member”) agree to these Terms.

1. What PreCheck Pros Is

PreCheck Pros is a homeowner membership service. Membership provides:

• A homeowner hotline for reaching us by call or text;
• Introductions to independent, licensed, pre-screened third-party contractors, including member-discounted rates where offered;
• General educational content about home maintenance;
• Self-service record-keeping tools (a place to keep your own photos, receipts, and service history);
• Seasonal maintenance reminders and similar membership benefits.

You hire and pay contractors directly for any work you authorize. PreCheck Pros is not a party to, and does not pay under, any agreement between you and a contractor.

2. What PreCheck Pros Is NOT (read carefully)

PreCheck Pros does not, and nothing in the Service should be interpreted as:

• Insurance advice or services. We do not sell insurance, advise you whether to file or not file a claim, interpret your specific policy for compensation, or represent you to any insurer.
• Public adjusting. We are not public adjusters and do not adjust, negotiate, or settle insurance claims on your behalf. If you need claim representation, we will refer you to a licensed public adjuster or attorney.
• Legal advice. We are not a law firm and do not provide legal representation.
• A warranty, home service contract, or extended service plan. We do not pay for, cover, reimburse, or guarantee any repair, replacement, or service, in whole or in part.
• Repair or restoration work. We do not perform any physical work on your property.
• A guarantee of outcomes. We do not guarantee claim approvals, repair quality, pricing, timelines, or any result.

All substantive decisions about insurance claims, repairs, and contractor selection are yours, ideally made with appropriately licensed professionals. Information we provide is general and educational and is not a substitute for professional advice.

3. Eligibility & Accounts

You must be 18+ and a property owner or authorized decision-maker. You are responsible for the accuracy of your information and for activity under your account.

4. Subscriptions, Billing & Auto-Renewal

• Plans and prices are shown at checkout. Subscriptions are billed in advance through our payment processor (Stripe).
• Auto-renewal: Your subscription automatically renews each billing period at the then-current price until you cancel. By subscribing you authorize recurring charges.
• Cancellation: You may cancel anytime by contacting hello@precheckpros.com; cancellation stops the next renewal. Access continues through the paid period.
• Refunds: We do not provide refunds for partial billing periods, except where required by law.
• Price changes: We will give at least 30days’ notice before a price change affecting renewals.
• We honor applicable auto-renewal and “click-to-cancel” laws.

5. Contractor Referrals

• Contractors in our network are independent businesses, not our employees or agents. We do not supervise or control their work.
• We may receive compensation from contractors (referral or preferred-placement fees). This may influence which contractors are featured. Always obtain your own quotes and verify licensing/insurance.
• We screen contractors at onboarding but cannot guarantee that credentials remain current or that past performance predicts results. Conduct your own due diligence.

6. Acceptable Use

You agree not to misuse the Service, submit false information, infringe others’ rights, or use the Service for unlawful purposes.

7. Communications & Consent (TCPA)

By providing your phone number and opting in, you consent to receive calls/texts (which may be autodialed or pre-recorded) from PreCheck Pros and, where you request, from referred contractors, for service and (if separately checked) marketing. Consent is not a condition of purchase. Message/data rates may apply. Reply STOP to opt out. See our Privacy Policy.

8. Intellectual Property

The Service, content, and trademarks are owned by PreCheck Pros LLC. We grant you a limited, revocable, non-transferable license to use the Service for your personal property decisions.

9. Disclaimers & Limitation of Liability

• “AS IS.”The Service and all information are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.
• No professional relationship. Use of the Service does not create an insurance, legal, fiduciary, or public-adjuster relationship.
• Limitation.To the fullest extent permitted by law, PreCheck Pros’ total liability for any claim arising out of the Service will not exceed the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for the acts, omissions, work, or pricing of any contractor or third party.
• Indemnity. You agree to indemnify PreCheck Pros against claims arising from your misuse of the Service or violation of these Terms.

10. Dispute Resolution & Binding Arbitration

Please read this section carefully — it affects your legal rights. These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules.

Agreement to arbitrate. Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in Franklin County, Ohio, or by video or phone where the rules allow, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver.You and PreCheck Pros agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

Jury-trial waiver. You and PreCheck Pros waive any right to a jury trial in any dispute covered by this section.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect its intellectual property or confidential information.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@precheckpros.com with your name and a statement that you decline to arbitrate. Opting out does not affect any other part of these Terms.

11. Changes

We may update these Terms; material changes will be notified via the Service or email. Continued use means acceptance.
